Terms & Conditions
Last updated: 12 March 2026
1. Acceptance of Terms
By accessing or using Digital SME Tool Box (“the Service”), including the diagnostic questionnaire, dashboard, report, and PDF download feature, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. The Service is provided by Garba (“we”, “us”, or “our”).
2. Description of the Service
Digital SME Tool Box is a diagnostic tool that helps you assess your business’s digital workflow maturity. It includes: (a) a short questionnaire covering communication, documents, scheduling, finance, and workflow; (b) a digital score and category breakdown; (c) a dashboard and report with insights and suggested next steps; and (d) the ability to download your report as a PDF. Results are generated based on your answers and are for informational and self-assessment purposes only.
3. Use of the Service
You agree to:
- Provide accurate and complete information when using the diagnostic.
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not attempt to reverse-engineer, disrupt, or compromise the Service or its security.
- Not use the Service in any way that could harm us, other users, or third parties.
The Service is intended for use by businesses and individuals assessing their own or their organisation’s practices. You are responsible for maintaining the confidentiality of any data stored in your browser (e.g. diagnostic results).
4. No Professional Advice
The Service provides general information and self-assessment only. It does not constitute legal, financial, accounting, or other professional advice. Your score, insights, and suggested steps are indicative and should not be relied upon as a substitute for advice from qualified professionals. You are responsible for any decisions you make based on the Service.
5. Intellectual Property
The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent. You may download your report as a PDF for your own use in accordance with these Terms.
6. Disclaimer of Warranties
The Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by applicable law, we (and our affiliates, officers, and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claims arising from the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or, if the Service is free, zero. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify and hold harmless us and our affiliates, officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
9. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may also update these Terms; the “Last updated” date will reflect the latest version. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
10. Governing Law and Disputes
These Terms shall be governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory law.
11. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
